Terms of Service

The contractual terms that govern access to W Chews, credit packs, generated content, and acceptable use.

Effective Date: November 3, 2026

Last Updated: November 4, 2026

1. Acceptance Of These Terms

These Terms of Service ("Terms") govern your access to and use of W Chews’s websites, applications, generation tools, and related services (collectively, the "Services").

These Terms are between you and the operator of W Chews, identified as wchews.org ("we," "us," or "our").

By accessing or using the Services, you agree to be bound by these Terms. If you use the Services on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.

If you do not agree to these Terms, do not use the Services.

2. Eligibility And Accounts

You must be legally capable of entering into a binding contract in your jurisdiction to use the Services.

You are responsible for:

  • providing accurate account information;
  • maintaining the confidentiality of your login credentials;
  • all activities that occur under your account; and
  • promptly notifying us of any unauthorized use or security incident.

We may suspend or restrict access where reasonably necessary to protect the Services, other users, third parties, or our legitimate business interests.

3. Description Of The Services

W Chews is an independent AI video service for creating short food-reaction memes with instrumental background music and nonverbal performances from a food photo and your own or an authorized adult portrait. You can choose our original AI-created character instead of uploading a portrait. Select W Chews or L Nibbles and a video format. These choices use fixed templates and fixed on-screen wording; custom prompts, food descriptions, dialogue and captions are not accepted. A photo preview by itself does not submit a generation request.

Underlying model. Videos are generated with Seedance 2.0 Mini (ByteDance Seedance), accessed through a third-party AI infrastructure provider. W Chews is not made, endorsed, or sponsored by ByteDance, TikTok, CapCut, or any model provider. Outputs are AI-generated performances, not footage of a real meal, a real food review, statement or endorsement. The fixed template requests instrumental background music without lyrics or vocals. We do not offer speech, lip sync, voice uploads or voice cloning. Review the generated music and mouth movement before sharing. On-screen text is rendered by the video model, so spelling, placement and other details can vary.

Available features, file-size limits, supported media types, output options, and credit costs may change over time. The interface shows the options and price for a request before submission.

4. Acceptable Use Policy

This section is our Acceptable Use Policy ("AUP"). It applies to every upload, request, and output.

4.1 Prohibited content

You may not upload, request, generate, or distribute:

  1. Pornography or sexual content (NSFW): nudity, sexually explicit or suggestive material, or any attempt to undress or sexualize a person.
  2. Violence or gore: graphic violence, injury, cruelty to people or animals, or threats.
  3. Hate speech: content that attacks or demeans people based on race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation, or similar characteristics.
  4. Child-unsafe content: any content involving minors in a sexual, abusive, or exploitative context (CSAM). Photos of minors are not allowed at all.
  5. Deepfakes and impersonation: face swaps, "nudify" edits, fabricated intimate scenes, unauthorized use of a person's likeness, generated speech attributed to a real person, or presenting a synthetic performance as real footage, an actual food review or an endorsement. Celebrities, public figures and politicians may not be used as character references.
  6. Copyright or trademark infringement: images you do not have the right to use, copyrighted characters, or brand logos and trademarks.

You also may not use the Services to violate any law; infringe privacy or publicity rights; facilitate fraud, phishing, or harassment; upload malware or interfere with the Services; scrape, reverse engineer, or build a competing service except where such a restriction is prohibited by law; or bypass limits or abuse credits.

4.2 Photos and adult consent

The food photo must contain food and no people or faces. The separate portrait must show you or one adult who has authorized use of their image for this AI animation. Do not upload photos of minors, celebrities or public figures. You may use our original fictional character instead. Voice uploads and free-text generation instructions are not accepted.

Before generation you must confirm: "I have rights to both photos. Any real person shown is an adult and has consented. No public figures, and no people in the food photo." Generation is blocked until you confirm, and the confirmation is checked again on our servers. Consent does not permit any prohibited use listed above. Clearly identify the result as AI-generated when sharing it; the written verdict is meme commentary, not a real person's testimony.

4.3 Moderation

We moderate automatically before and after generation: the fixed generation text is checked using Waffo Prompt Sift and text safety filters, and generated videos are screened using Amazon Rekognition. Uploaded portraits and food photos are used as the respective image references. Blocked requests are not generated, and blocked outputs are not shown. Moderation results are logged, and we may review flagged content manually.

4.4 Reporting

To report a generated video or an upload that breaks this policy, email support@wchews.org with the video link or generation ID and a short description. We review reports, usually within 2 business days, and remove violating content.

4.5 Enforcement and appeals

Depending on severity, we may block the generation, remove content, forfeit credits used for violating requests, suspend or terminate the account, and report illegal content (including CSAM) to the authorities. If you believe we made a mistake, reply to our notice or email support@wchews.org to appeal; a person will review it.

5. Customer Inputs And Outputs

You retain whatever rights you have in the prompts, uploads, and other materials you submit to the Services ("Inputs").

Subject to your compliance with these Terms and the rights of any third parties, you may use the resulting generated materials ("Outputs") for lawful business or personal purposes.

You are solely responsible for:

  • ensuring that you have the rights and consents necessary to submit Inputs, and keeping all people out of food photos submitted for generation;
  • disclosing that Outputs are AI-generated when you share them;
  • reviewing Outputs before use;
  • complying with advertising, consumer-protection, intellectual property, privacy, and platform rules applicable to your use of Outputs; and
  • determining whether Outputs are suitable for your intended use.

Because AI systems are probabilistic, Outputs may be inaccurate, incomplete, or similar to content generated for other users. We do not guarantee uniqueness, non-infringement, fitness for a particular purpose, or uninterrupted availability.

6. Credit Packs And Billing

W Chews sells one-time credit packs in US dollars, starting at US$9.90. We do not sell subscriptions or automatically renew credit purchases.

By purchasing a credit pack, you authorize us and our payment processors to charge the fees and any taxes disclosed at checkout. The pack price and included credits shown before purchase form part of the purchase terms for that transaction. If no packs are available, checkout is unavailable.

Purchased credit pack balances remain available until used and do not have a monthly reset. A generation request uses the credit amount shown before you submit it. Credits may be reserved while a request is being processed; the account records show the resulting charge or release.

Credits may still be consumed where a request has been processed but its input or output is blocked or withheld because of safety checks, moderation decisions, abuse-prevention rules, or acceptable-use enforcement. A cash refund and the release of reserved credits are separate actions.

7. One-Time Purchases

There is no recurring billing to cancel. For a question about a credit purchase or an unexpected charge, contact support@wchews.org and include your order reference.

8. Refunds

Refunds are governed by our separate Refund Policy, which forms part of these Terms.

Where we approve a discretionary refund, we may deduct a 10% processing fee from the refundable amount to reflect non-recoverable payment-processing, currency-conversion, and administrative costs, including costs associated with the payment provider used at checkout.

However, this fee does not apply where a full refund is required by applicable law, or where we determine that the charge resulted from duplicate billing, an unauthorized charge, or a material service failure for which a full refund is appropriate.

9. EU, EEA, And UK Consumer Notice

If you are a consumer in the EU, EEA, or UK, you may have statutory rights that cannot be waived by contract.

Where the Services include digital content, digital services, immediate access to credits, or immediate performance of generation tools, you may be asked to expressly consent to immediate performance and acknowledge that your statutory right of withdrawal may be reduced or lost once performance begins, to the extent permitted by applicable law.

Nothing in these Terms limits any mandatory consumer rights that apply to you under the law of your country of residence.

10. Intellectual Property

The Services, including our software, interfaces, branding, site content, and underlying technology, are owned by the service operator or its licensors and are protected by intellectual property and other laws.

Except for the limited right to use the Services in accordance with these Terms, no license or ownership right is granted to you in the Services themselves.

11. Privacy

Your use of the Services is also subject to our Privacy Policy, which explains how we collect, use, store, and disclose personal data.

12. Third-Party Services

The Services may rely on third-party providers, including hosting providers, payment processors, analytics tools, and AI infrastructure or generation providers.

We are not responsible for the independent products, services, or policies of third parties, except as required by law.

13. Service Changes, Suspension, And Termination

We may modify, suspend, or discontinue any part of the Services at any time, with or without notice, where reasonably necessary for product updates, maintenance, security, legal compliance, or business reasons.

We may suspend or terminate your access immediately if we reasonably believe you violated these Terms, posed a security or legal risk, engaged in fraudulent or abusive activity, or used the Services in a manner that could cause harm to us, our users, or third parties.

14. Disclaimers

To the fullest extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, or error-free operation.

We do not warrant that Outputs will meet your expectations, be accepted by any advertising platform, or remain continuously available for download.

15. Limitation Of Liability

To the fullest extent permitted by law:

  • we are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, data, or business opportunity; and
  • our aggregate liability arising out of or relating to the Services or these Terms will not exceed the greater of the amount you paid us in the 12 months before the event giving rise to the claim or USD $100.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including certain consumer rights or liability for fraud, fraudulent misrepresentation, death, or personal injury caused by negligence where such exclusions are prohibited.

16. Indemnity

To the extent permitted by law, you will indemnify and hold harmless the service operator and its affiliates, officers, directors, employees, and agents from claims, losses, liabilities, damages, and expenses arising from:

  • your Inputs or use of Outputs;
  • your violation of these Terms;
  • your violation of applicable law; or
  • your infringement or misappropriation of the rights of another person or entity.

17. Changes To These Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms and revise the date above. Your continued use of the Services after the effective date of the updated Terms constitutes acceptance of the revised Terms, except where applicable law requires a different process.
